1. Overview
This website is operated by Oh My Melt (“Oh My Melt”, “we”, “us”, “our”). By accessing www.ohmymelt.co.uk (the “Site”) and/or purchasing from us, you agree to these Terms of Service (“Terms”). Please read them carefully. If you do not agree, you must not use the Site.
Our store is hosted on Shopify Inc., which provides the e-commerce platform that enables us to sell our products and services to you.
Nothing in these Terms affects your statutory rights.
2. Eligibility & Use
You represent that you are at least 16 and, if under the age of majority in your region, you have parental/guardian consent to use the Site. You must not use the Site for any unlawful purpose or violate any applicable law.
3. Your Account
You agree to provide current, complete and accurate information and to promptly update it (including email, addresses and payment details) so we can complete your transactions and contact you as needed. We may refuse, limit or cancel orders at our discretion (e.g., suspected fraud, resale activity).
4. Products, Pricing & Availability

Product descriptions and images are provided in good faith; minor variations (e.g., colour on different screens) may occur.

We may limit quantities per person/household/order.

An order is accepted when we dispatch your items and send a dispatch confirmation email.
5. Shipping & Delivery
Shipping options, costs and timeframes are described on our Delivery & Shipping page. Title and risk pass to you upon delivery. If a parcel is delayed or missing, please contact us so we can assist with an investigation.
6. Returns, Refunds & Exchanges
Our Returns & Refunds Policy forms part of these Terms. Please review it before purchasing. Where required by law, you may be entitled to cancel within the applicable statutory period. For hygiene/safety reasons, used/opened fragrance products may not be returnable unless faulty (see policy for details).
7. Payments
We accept various payment methods, including cards and approved BNPL providers (e.g., Clearpay, Klarna, Laybuy), subject to their own terms. By submitting a payment method, you confirm you are authorised to use it and authorise us (and our payment processors) to charge the full order amount, including taxes, shipping and any discounts applied.
7A. BNPL Disclosures (Klarna, Clearpay, Laybuy)
Where you choose a “Buy Now, Pay Later” option at checkout:

Your agreement is with the BNPL provider and is subject to that provider’s own terms, privacy policy, and eligibility checks.

BNPL availability is not guaranteed and may vary by order value, products, and your personal circumstances.

Missed or late payments may affect your creditworthiness and could incur fees.

We do not decide BNPL eligibility and cannot influence the provider’s decision.
8. Promotions, Gift Cards & Discounts
Promotional codes are single-use unless stated, non-transferable, not redeemable for cash and may be subject to additional terms. Gift cards are issued and redeemed according to the terms displayed at purchase.
9. Subscriptions & Recurring Payments
Some products or bundles may be offered as subscriptions (e.g., recurring deliveries).

Your payment details are stored securely and charged automatically for each delivery, unless you choose to prepay.

If a payment fails, we may retry. If it cannot be processed, we may pause or cancel your subscription.

Auto-renewals

Some subscriptions renew automatically at the end of their term.

If you don’t want to renew, you must cancel before the next billing date.

Cancellations

You can cancel your subscription at any time before your next billing date.

Cancellations made after a payment has been processed will apply to the following billing cycle.

10. User Content & Reviews
If you submit reviews, photos or comments (“User Content”), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content for marketing and operational purposes. You must not submit unlawful, infringing, misleading, or offensive content. We may moderate/remove User Content at our discretion.
11. Intellectual Property
All content on the Site (including text, graphics, logos, images and software) is owned by or licensed to Oh My Melt and is protected by intellectual property laws. Oh My Melt® is a registered trademark in the UK. You must not copy, distribute or create derivative works without our prior written consent.
12. Third-Party Services & Links
The Site may contain links to third-party websites or integrate third-party tools (including Shopify, analytics, payment and courier partners). Use of such services is at your own risk and subject to those third parties’ terms and privacy policies.
13. Acceptable Use
You must not: (a) engage in unlawful, harmful, fraudulent or abusive activity; (b) introduce viruses or malicious code; (c) attempt to gain unauthorised access to the Site or other accounts; (d) scrape or harvest data without consent; (e) misrepresent your identity or affiliation.

Your submission of personal information through the Site is governed by our Privacy Policy. Please review it to understand how we collect and process your data.
15. Warranties & Disclaimers
Except as required by law, the Site and all products/services are provided “as is” and “as available.” We do not warrant that the Site will be uninterrupted, timely, secure or error-free.
16. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Subject to the foregoing, we shall not be liable for: (a) loss of profits, revenue, savings, data, or business; or (b) indirect or consequential loss. Our total aggregate liability for any loss or damage arising out of or in connection with your use of the Site or purchase of products shall not exceed the total amount paid by you for the relevant order.
17. Events Outside Our Control
We are not liable for any delay or failure to perform due to events beyond our reasonable control (e.g., strikes, natural disasters, carrier delays, utility outages, acts of government). We will take reasonable steps to mitigate and keep you informed.
18. Suspension & Termination
We may suspend or terminate your access to the Site if you breach these Terms, pose a security/fraud risk, or if required by law. Obligations and liabilities incurred prior to termination shall survive.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers resident elsewhere in the UK/EEA may benefit from mandatory local consumer protections and bring proceedings in their local courts.
20. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page. Your continued use of the Site after changes are posted constitutes acceptance.
